Ms. McEldowney is Special Counsel at Damon Morey in the Health Care Practice
Group of the Firm’s Corporate Department. Ms. McEldowney has been active in the corporate and health care legal community since her admission to the New York
State Bar in 1986. Her prior positions include having served as Deputy Counsel for Independent Health Association and Vice President and General Counsel of a local
third party administrator, North American Health Plans, Inc.
Ms. McEldowney practices in the areas of health law, corporate law, and employee
health benefits, with a focus on federal and state regulatory compliance, including
HIPAA, patient care issues, medical ethics, fraud and abuse issues, Medicare and
Medicaid reimbursement, and vendor contracting. Her practice involves
representation of hospitals, skilled nursing facilities, physicians, not-for-profit
organizations, and self-funded employer group health plans.
Ms. McEldowney is a member of the American Health Lawyers Association, the
New York State Bar Association, and the Bar Association of Erie County’s Health
Law Committee. Ms. McEldowney is also a member of the Western New York
Chapter of the Women's Bar Association of the State of New York. She lectures
frequently on health issues across the state. Topics on which she has spoken
include Contractual Rights of the Patient/Enrollee, HIPAA/HITECH Compliance,
Fraud and Abuse Compliance, Advance Directives, and Medical Ethics.
Ms. McEldowney is a member of the Healthcare Executive Forum, a not for profit
professional membership organization that is the Western New York Chapter of the
American College of Healthcare Executives.
A graduate of Rutgers University, Ms. McEldowney received her J.D. degree from
the State University of New York at Buffalo, where she served as a Note and
Comment Editor on the Buffalo Law Review.
