Occupational Safety and Health and Community Right-to-Know - OSHA and EPCRA

Since enactment of the Occupational Safety and Health Act in 1970, Damon & Morey has represented clients in proceedings and litigation concerning workplace safety and standards. We have advised clients on their obligations under the federal Hazard Communications Standard, and on related state and local worker right-to-know laws. As part of its environmental compliance activities, the firm has assisted clients with the federal reporting, inventory and community awareness programs mandated in the Emergency Planning and Community Right-to-Know Act of 1986 (EPCRA).

Our experience includes:

  • Developing computerized spreadsheet program to assist a manufacturing client with compliance under EPCRA. We have also represented clients involved in litigation under EPCRA.

  • Defending a small manufacturing company in an EPCRA citizen’s suit initiated in federal court. As part of this defense, the firm conducted a broad compliance review for this client.
