Insolvency
Damon Morey’s Business Litigation and Insolvency Department was formed to address the special needs businesses develop when they are embroiled in disputes with other businesses. Our attorneys understand not only businesses and business law, but also the intricacies of how to best enforce and collect the judgments we recover.
Our practice involves the disputes that arise between businesses, shareholders, investors, business partners and their competitors. Major areas include:
- Corporate governance litigation, including corporate and partnership dissolution
- Bankruptcy cases, including Chapter 11 reorganizations, debtors, creditor committees, trustees, and secured and unsecured creditors
- Construction litigation representing owners, architects, engineers, contractors, subcontractors, materialmen and bonding companies
- Uniform Commercial Code matters, including disputes over the sales of goods, checks and promissory notes, and secured transactions
- Disputes over intellectual property
- Violation of non-competition and confidentiality agreements
- Pursuing and defending provisional remedies (i.e., injunction, receivership, attachment)
- Mortgage foreclosure and collection, including both commercial and consumer accounts
Understanding that each attorney has specific areas of concentration, we assign matters to the attorney best able to resolve your issue. Additionally, we tailor our staffing based on the complexity, urgency and exposure involved. By calling on our team’s full range of knowledge and experience, we create a unique level of flexibility, which enables our attorneys to efficiently and cost-effectively handle consumer collections while also pursuing complex litigation involving tens of millions of dollars.
Our departmental attorneys have a proud history of representing clients in state, federal and bankruptcy courts as well as in commercial and construction alternative dispute resolution. Our experienced attorneys proceed to trial or arbitration when an acceptable settlement cannot be reached.
