Special Education Law

Damon Morey attorneys have experience providing advice concerning all aspects of the laws impacting students with disabilities. We can provide general assistance in drafting policies and procedures, as well as provide training to help prevent our school clients from encountering procedural problems that may lead to unnecessary litigation.

We routinely advise our school and not-for-profit education clients on issues involving the federal Individuals with Disabilities Education Act, including IEPs, related services, behavioral plans and appropriate placements in the least restrictive environment. We have experience handling CSE meetings, as well as resolution meetings, manifestation meetings, mediation and issues resulting from parent complaints filed with the New York State Education Department. Our experience also includes advice under issues under Section 504 of the Rehabilitation Act, negotiating appropriate resolutions to compliance complaints filed with the New York State Education Department and complaints of discrimination based on disability with the federal Office for Civil Rights (OCR).

Damon Morey is also experienced in all aspects of due process appeals to federal and state courts, as well as handling actions for attorneys’ fees.
