Damon & Morey has long been recognized as one of the leading health
care firms in New York State. The firm became actively engaged in the
practice of health care law in the early 1970s with the representation
of an acute care hospital. Since that time, the firm has developed a
substantial and successful health care practice that impacts on all
areas of the law served by the firm.
The firm is general or special counsel to a wide variety of health care
providers, including health care systems, hospitals, nursing homes,
adult care facilities, and home health agencies. The firm also
represents not-for-profit health and human service organizations that
provide housing, health care and social services, children’s services,
day habilitation and service coordination. Our attorneys also counsel
medical groups and health care practitioners, including such individuals
as physicians, dentists and allied health professionals.
Our Business and Corporate Department
attorneys work extensively with health care clients on matters involving
the regulation, delivery and financing of health care. Our regulatory
attorneys handle corporate compliance (including regulatory, tax, and
anti-trust matters), reimbursement, fraud and abuse, managed care, and
HIPAA and health information privacy issues. These attorneys also
regularly advise health care and human service providers on licensure,
certification, survey, and enforcement matters. Additionally, they
counsel health care providers on specific health service delivery and
patient care issues including patient treatment, admission, discharge,
involuntary commitment, medication, and guardianship. The firm also
counsels health care providers on reimbursement, licensure,
credentialing, employment and discipline matters. Additionally, our
corporate attorneys routinely handle corporate and network creation,
restructuring, governance and mergers and acquisitions.
Our Labor and Employment Department
attorneys counsel the firm’s health care clients on matters involving
employment, discrimination, collective bargaining and related issues.
They also advise our health care clients on matters involving ERISA,
employee benefits and executive compensation plans.
The vast experience of our Litigation
Department attorneys is crucial to the firm’s health care clients.
We have significant experience defending providers in negligence,
personal injury, sexual harassment, molestation, and wrongful death
cases. Many of the firm’s litigators defend hospitals, nursing homes,
home care agencies, adult care facilities, and health care professionals
in medical malpractice and negligence actions.
Our Litigation Department attorneys also provide
risk management consulting services for liability insurance
carriers, their insureds, and other providers. In addition, several of
the firm’s trial attorneys devote an extensive portion of their practice
to other health care issues, including enforcement defense and
regulatory actions, third-party payment litigation, construction
litigation, toxic torts and general litigation.
In addition, two Damon & Morey attorneys hold advanced degrees in
nursing. One of these attorneys served as the president of the American
Association of Nurse Attorney and was the founder and president of the
Western New York Chapter. Our firm also employs a number of paralegals
with advanced nursing degrees.
