 Exposure to Hazardous
Materials - Toxic Torts
Attorneys in the environmental law practice group have defended
hundreds of toxic tort and related exposure cases for the firm’s
clients. The government’s increasing focus on the environmental and
health hazards associated with the production, handling and disposal of
asbestos, PCBs, and other “hazardous materials” has greatly increased
public concern about these materials. This heightened public concern, in
turn, has led to a sharp increase in personal injury and property damage
litigation by individuals who have been harmed by exposure to hazardous
materials and wastes.
We have handled hundreds of cases throughout New York in both federal
and state courts involving hazardous waste sites and exposure to toxic
substances, such as asbestos, urea formaldehyde foam insulation, DES and
TCE. In addition, the firm has litigated cases involving lead paint
poisoning.
Damon & Morey clients have the benefit of a large litigation support
team, one comprised of well-trained legal assistants experienced with
these types of claims. The firm also employs nurses whose review of
medical records is crucial to exposure cases.
Specific examples of our experience include:
- Serving as regional trial counsel for a major manufacturer and
defending numerous cases involving alleged exposure to
asbestos-containing materials.
- Represented numerous defendants in asbestos litigation and served
as defense liaison counsel for various matters.
- Represented a manufacturer of beryllium in claim exposure matters.
- Represented a site in claimed toxic exposure cases involving
hundreds of residents.
